Nema Kunku Village Development Community in Diaspora — Constitution (2025/26)
Adopted for the orderly administration and development of Nema Kunku at home and abroad.
Preamble
We, members of the Nema Kunku community in the Diaspora and at home, affirm our commitment to unity, transparency, and service. This Constitution guides our governance, meetings, finances, and projects for the collective benefit of our community.
Article 1 — Name & Establishment
The association is called Nema Kunku Village Development Community in Diaspora (NKD).
Date of formation: 03 January 2018. NKD is non-political, non-profit, and community-driven.
Article 2 — Headquarters & Legal Status
Headquarters: Spain (Montornès del Vallès, Barcelona).
Registration: in process with a legal representative/lawyer in Spain.
NKD operates internationally with members in the Diaspora and at home.
Article 3 — Aims & Objectives
- Support development projects and essential services in Nema Kunku.
- Promote solidarity and welfare, including defined member benefits.
- Ensure transparent, accountable operations.
Article 4 — Membership
- Membership is open to any individual committed to unity, transparency, and sustainable development of Nema Kunku.
- No registration fee; contribution begins in the year a member joins.
Article 5 — Governance Structure
- Legal Founding Representatives (Spain): mandated for registration and banking purposes.
- Operational Executive Committee: manages daily operations, projects, finance, and meetings.
- Roles and responsibilities follow internal regulations and approved schedules of duties.
Article 6 — Meetings
- General Meetings: last Sunday of each month at 16:00 CET.
- Emergency Meetings: may be called with at least 7 days’ notice.
- Attendance is recorded; minutes and resolutions are circulated to members.
Article 7 — Finance & Accounts
- Funds derive from member contributions, donations, and approved fundraising.
- Bank accounts are opened per legal requirements; approvals follow internal controls.
- Transparent records of income, expenditure, projects, and audits are maintained.
Article 8 — Discipline & Arrears
- Members in arrears from 2018–2024 are subject to a penalty starting 1 September 2025.
- Members with no arrears must pay the 2025 contribution by 31 December 2025 or face a late penalty (per policy).
- Members penalized for 2018–2024 are not penalized again for the same arrears.
Article 9 — Amendments & Dissolution
- Amendments require proper notice and approval at a duly convened meeting.
- Upon dissolution, assets are disposed in line with law and community interest.
